KidoPulse Terms of Use

These Terms of Use ("Terms") apply to the KidoPulse mobile application for iOS and Android (the "App"), provided by TrackIt ("we", "us"). By downloading or using the App, you agree to these Terms. If you do not agree, do not use the App.

KidoPulse helps a parent or guardian create child profiles, build reusable activity templates, schedule one-time or recurring activities, and set reminder alarms for them (for example, an evening-before reminder, a time-to-prepare alarm or a time-to-leave alarm). Alarms and notifications are scheduled locally on your device using the operating system's alarm and notification features. The App has no account system and does not store your content on our servers.

The App is intended to be used by an adult parent or guardian as a personal organisation aid. It is not intended to be set up or used by a child without supervision. You are responsible for the accuracy of the profiles, activities and alarms you create.

KidoPulse is a scheduling and reminder tool. It is not a safety, supervision, childcare or emergency product. Alarms and notifications depend on factors outside our control, including device settings, permissions, battery and power-saving features, operating-system behaviour and updates, the device being powered on, and volume or Focus/Do Not Disturb settings. An alarm may be delayed, may not sound, or may not be noticed. You remain solely responsible for your child's schedule, attendance, transportation, supervision and safety, and you should not rely on the App as the only means of remembering any time-sensitive or important event.

Content you enter is stored on your device. Because we do not hold a copy, we cannot recover it if your device is lost, damaged, reset, or if the App is deleted. The App offers a backup export and import feature; creating and safely storing backups is your responsibility. You retain all rights to the content you enter.

The App can be used free of charge with certain limits (currently one child profile and one scheduled activity at a time; activity templates are not limited). KidoPulse Pro is an optional subscription that removes these limits and may include additional features we introduce. Features and limits of the free version and of Pro may change over time.

• Pro is offered as an auto-renewing subscription with the periods and prices shown in the App before purchase.
• Payment is charged to your Apple ID or Google Play account at confirmation of purchase.
• The subscription renews automatically unless cancelled at least 24 hours before the end of the current period. Your account will be charged for renewal within 24 hours before the end of the current period.
• If a free trial is offered, any unused portion of it is forfeited when you purchase a subscription, where applicable.
• You can manage or cancel your subscription in your App Store or Google Play account settings. Deleting the App does not cancel a subscription.
• Refunds are handled by Apple or Google under their policies.
• You can restore a previous purchase from within the App.
• If a Pro subscription ends, content that exceeds the free limits is kept but becomes read-only until you subscribe again; alarms already scheduled for it remain scheduled.

You agree not to misuse the App, including by attempting to reverse engineer, modify, circumvent purchase or licensing restrictions, or interfere with the App or its services, except to the extent such restrictions are prohibited by law.

The App, its design, content and software are owned by TrackIt or its licensors and are protected by intellectual property laws. You receive a limited, non-exclusive, non-transferable, revocable licence to use the App for personal, non-commercial purposes in accordance with these Terms and the applicable app store terms.

The App uses third-party services, including Adapty (subscriptions), Amplitude (analytics) and Expo (app infrastructure and updates), as described in our Privacy Policy. Purchases are processed by Apple or Google under their own terms.

These Terms are between you and TrackIt, not Apple or Google. Apple and Google are not responsible for the App or its content and have no obligation to provide maintenance or support for it. Support questions should be sent to trackit.tr@gmail.com. If you obtained the App from the Apple App Store, Apple's Licensed Application End User License Agreement also applies, and Apple and its subsidiaries are third-party beneficiaries of these Terms with the right to enforce them against you. If you obtained the App from Google Play, the Google Play Terms of Service also apply.

To the maximum extent permitted by law, the App is provided "as is" and "as available", without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose and non-infringement. We do not warrant that the App will be uninterrupted or error-free, or that any alarm or notification will be delivered, sound, or be noticed at a particular time.

To the maximum extent permitted by law, TrackIt will not be liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of data, missed or late activities, missed appointments, or other outcomes resulting from an alarm or notification that was delayed, did not sound, was dismissed or was not noticed, arising out of or related to your use of or inability to use the App. To the extent liability cannot be excluded, our total liability is limited to the amount you paid for the App in the twelve (12) months before the claim. Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law, or affects your mandatory rights as a consumer.

We may modify, suspend or discontinue features of the App, and we may update these Terms. Updated Terms will be posted on this page with a revised “Last updated” date. If you continue to use the App after an update takes effect, you accept the updated Terms.

These Terms are governed by the laws of the Republic of Türkiye, without prejudice to any mandatory consumer protection laws of the country where you live.
